1 AGREEMENT BETWEEN USER AND hostelmania.com

This Site is offered to you, the customer, by hostelmania Ltd trading as www.hostelmania.com, on condition of your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the Site constitutes your agreement to all such terms, conditions, and notices and such amendments and modifications as may be incorporated from time to time. If you do not agree with any part of the following terms, conditions and notices, you may not use the Site.

This agreement is subject to the laws of United Kingdom. You hereby consent to the exclusive jurisdiction of the UK Courts in all disputes arising out of or relating to the use of the Site.

hostelmania.com is provided solely to give you general information on destinations and to assist you in determining the availability of accommodation, to make legitimate reservations, or to otherwise transact business with suppliers, and for no other purpose. You warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement and to use this Site in accordance with all the Terms and Conditions herein on your own behalf or on behalf of another.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and hostelmania.com as a result of this agreement or use of the Site. Please review our Privacy Notice, which also governs your visit to the Site, to understand our practices. The Privacy Notice is deemed incorporated into these Terms and Conditions.

This Site is for your personal and non-commercial use. hostelmania.com grants you a limited, non-exclusive, revocable license to access and make personal use of the Site for non-commercial purposes. You may only use the Site to search for accommodation and related information, post reviews or other related content, all in compliance with these Term and Conditions. You shall not use the Site for any other purposes. No automated use of this website, whether by means of a robot, spider, scraper or other means, is permitted.

This license does not include any authorisation to collect and use accommodation listings, descriptions prices or other content on the Site, except for personal noncommercial purposes, or to reverse engineer any portion of the Site, and all such uses are strictly prohibited. You agree that you will not interfere with the operation of the Site, or take any action, that imposes an unreasonable burden or load on the Site infrastructure. You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary content (including images, text, page layout, or form) on the Site without our express prior written consent.

You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of the Site so long as, in hostelmania.com's sole judgment, the link does not portray hostelmania.com, or its services, in a false, misleading, derogatory, or otherwise offensive manner, or associate hostelmania.com with undesirable products, services, or opinions, or cause confusion among customers or potential customers. You may not use any hostelmania.com logo or other proprietary graphic or trademark as part of such link without express written permission. You may not use any meta tags or any other hidden text utilizing hostelmania.com's name or trademarks without the express written consent of hostelmania.com. Any unauthorized use automatically terminates the consents and licenses granted by hostelmania.com under these Terms and Conditions and may subject you to other legal actions.

The Site may contain terms that govern particular features or offers. In the event that any of the terms, conditions, and notices contained herein conflict with the additional terms or other terms and guidelines contained within hostelmania.com website, then these Terms and Conditions shall prevail.

hostelmania.com may, and you may not, assign, delegate or subcontract rights and duties arising from your use of the Site.

hostelmania.com reserves the right to change these Terms and Conditions including but not limited to the charges associated with the use of the Site. You are responsible for regularly reviewing these Terms and Conditions. hostelmania.com has endeavored to ensure that all the information on the Site is correct, but hostelmania.com neither warrants nor makes any representations regarding the accuracy or completeness of any data or information.

3 CONTENT

Through the Site hostelmania.com provides you with an accommodation booking and information service. hostelmania.com does not own or operate any of the accommodation offered through the Site and all bookings are made directly with the accommodation service provider. Prior to making a booking using the Site you should check that the accommodation providers terms and conditions are acceptable to you. Deposits and booking fees are payable to hostelmania.com and are non refundable.

hostelmania.com makes every effort to ensure that the description and content on each page of the Site is correct and accurate. By using this Site you acknowledge that hostelmania.com is not responsible for errors or inaccuracies in the Site’s content, including but not limited to accommodation descriptions, charges and specifications, or for any loss or damages suffered by you as a result of any error or inaccuracy. hostelmania.com reserves the right to make changes to the content of the Site including but not limited to changes which occur after a service has been provided by the Site. Any services offered and provided by hostelmania.com shall be subject to such terms and conditions, changes, modifications and amendments as may be applicable.

4 NO LIABILITY FOR ARRANGEMENTS WITH ACCOMODATION PROVIDERS

hostelmania.com acts only as a booking agent and is not liable whatsoever for any aspect of the arrangements between accommodation providers and you. In no circumstances shall hostelmania.com will be liable for the services provided by accommodation providers.

5 LINKS TO THIRD PARTY SITES

The Site contains hyperlinks to other web sites ("Linked Sites"). The Linked Sites are not under the control of hostelmania.com and hostelmania.com is not responsible for the content of any Linked Site, including without limitation any hyperlink contained in a Linked Site, or any changes or updates to a Linked Site. The inclusion of hyperlinks in the Site does imply endorsement of the contents of any Linked Site or association with their operators.

6 PROHIBITION AGAINST UNLAWFUL USE

By using the Site you unconditionally warrant that you will not use the Site for any purpose that is unlawful or contrary to these Terms and Conditions. You may not obtain or attempt to obtain any materials or information through any means where such material or information is not intentionally made available. In addition the Site shall not be used in any manner which could damage, disable, overburden, or impair it or interfere with any other person's use and/or enjoyment of the Site.

7 USE OF CLUBMANIA

The Site may contain services such as email, chat, bulletin board services, information related to various tourist spots, news groups, forums, communities, personal web pages, calendars, and/or other message (collectively, "CLUBMANIA"), you agree to use CLUBMANIA only to post, send and receive messages and material that are proper and related to the particular service. By way of example, and not as a limitation, you agree that when using CLUBMANIA, you will not:

Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.

Conduct or forward surveys, contests, pyramid schemes or chain letters.

Download any file posted by another user of a CLUBMANIA service that you know, or reasonably should know, cannot be legally distributed in such manner.

Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.

Violate any code of conduct or other guidelines, which may be applicable for or to any particular Communication Service.

Harvest or otherwise collect information about others, including e-mail addresses, without their consent.

Violate any applicable laws or regulations for the time being in force in or outside UK.

hostelmania.com has no obligation to monitor CLUBMANIA. However, hostelmania.com reserves the right to review materials posted to a CLUBMANIA service and to remove any materials in its sole discretion. hostelmania.com reserves the right to terminate your access(es) to any or all of the CLUBMANIA services at any time without notice for any reason whatsoever.

hostelmania.com reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in hostelmania.com's sole discretion.

You should take particular care while disclosing any identifying information in any CLUBMANIA service.

hostelmania.com does not control or endorse the content, messages or information found in any CLUBMANIA service and, therefore, hostelmania.com specifically disclaims any liability with regard to the CLUBMANIA services and any actions resulting from your participation in any CLUBMANIA service.

Materials uploaded to CLUBMANIA may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to any such limitations.

You agree to indemnify hostelmania.com and its affiliates for all claims resulting from content that you supply to a CLUBMANIA. You hereby grant hostelmania.com a nonexclusive, royalty-free, perpetual, transferable, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, sell, assign, translate, create derivative works from, distribute, and display throughout the world in any media, any content you submit to a CLUBMANIA. You further grant hostelmania.com and its affiliates and sublicensees the right to use the name that you submit in connection with such content.

8 THIRD PARTY ACCOUNT INFORMATION

You authorize hostelmania.com to access third party sites for the purpose of retrieving requested information, and you hereby appoint hostelmania.com as your agent for this limited purpose. While registering you will choose a password and you are responsible for maintaining the confidentiality of that password and account. You are fully responsible for all activities that occur while using your password or account. It is your duty to notify hostelmania.com immediately of any unauthorized use of your password or account or any other breach of security. hostelmania.com will not be liable for any loss that may be incurred by you as a result of unauthorized use of your password or account, either with or without your knowledge. You shall not use anyone else's password at any time.

9 FEES & PAYMENT

hostelmania.com reserves the right to charge listing fees for certain listings, as well as transaction fees based on certain completed transactions completed through the Site. hostelmania.com further reserves the right to alter any and all fees from time to time, without notice. You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of the Site.

10 USING THE SERVICES

hostelmania.com is responsible only for the transactions that are carried out through hostelmania.com. hostelmania.com is not be responsible for screening, censoring or otherwise controlling transactions, including but not limited to whether the transaction is legal and valid and in accordance with the laws of your country. You warrant that you will comply with all applicable laws and regulations regarding use of the Site.

11 LIABILITY DISCLAIMER

hostelmania.com hereby expressly disclaims any implied warranties imputed by the laws of any jurisdiction. If the you do not agree with any of the disclaimers above you may not use hostelmania.com. You expressly agree that use of the Site is at your sole risk. The Site is provided on an "as is" and "as available" basis. hostelmania.com may change the features or functionality of the Site at any time, in their sole discretion. hostelmania.com expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. The information, software, products, and services included in or available through the Site may include inaccuracies or typographical errors. Changes are and may be periodically added to the information herein. hostelmania.com may make improvements and/or changes in the Site at any time. Any advice received except through an authorized representative of hostelmania.com via the hostelmania.com website should not be relied upon for any decisions. hostelmania.com at its sole discretion reserves the right not to accept any customer order without assigning any reason thereof. Any contract to provide any service by hostelmania.com is not complete until full money towards the service is received from the customer and accepted by hostelmania.com. The maximum liability on part of hostelmania.com arising under any circumstances, in respect of any services offered on the site, shall be limited to the refund of total amount received from the customer for availing the services less any cancellation, refund or others charges, as may be applicable. In no case shall the liability include any consequential loss, damage or additional expense whatsoever.

In no event shall hostelmania.com and/or its suppliers be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Site. Neither shall hostelmania.com be responsible for the delay or inability to use the Site or related services, the provision of or failure to provide services, or for any information, software, products, services and related graphics obtained through the Site or otherwise arising out of the use of the Site whether based on contract, tort, negligence, strict liability or otherwise. The user understands and agrees any material and/or data downloaded or otherwise obtained through the use of the Site is done entirely at their own discretion and risk and they will be solely responsible for any damage to their computer systems or loss of data that results from the download of such material and/or data.

In case the user is not satisfied with any services provided under the Site or any portion of the Site, or with any of these terms of use, their sole and exclusive remedy is to discontinue using the Site.

THE SUPLIERS PROVIDING ACCOMODATION OR OTHER SERVICES FOR hostelmania.com ARE INDEPENDENT CONTRACTORS AND NOT AGENTS OR EMPLOYEES OF hostelmania.com. hostelmania.com IS NOT LIABLE FOR THE ACTS, ERRORS, OMISSIONS, REPRESENTATIONS, WARRANTIES, BREACHES OR NEGLIGENCE OF ANY SUCH SUPPLIERS OR FOR ANY PERSONAL INJURIEIS, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING THEREFROM. hostelmania.com HAVE NO LIABILITY AND WILL MAKE NO REFUND IN THE EVENT OF ANY DELAY, CANCELLATION, OVERBOOKING, STRIKE, FORCE MAJEURE OR OTHER CAUSES BEYOND THEIR DIRECT CONTROL, AND THEY HAVE NO RESPONSIBILITY FOR ANY ADDITIONAL EXPENSE, OMISSIONS, DELAYS, RE-ROUTING OR ACTS OF ANY GOVERNMENT OR AUTHORITY.

12 INDEMNIFICATION

You agree to defend and indemnify hostelmania.com, and any of its officers, directors, and employees against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by (i) you or on your behalf in excess of the liability described above; or
(ii) by third parties as a result of
(a) your breach of these Web Site Terms, Conditions and Notices or the documents referenced herein;
(b) your violation of any law or the rights of a third party; or
(c) your use of the Site.

13 PROPRIETARY RIGHTS

hostelmania.com may provide the user with content such as sound, photographs, graphics, video or other material contained in sponsor advertisements or information. This material may be protected by copyrights, trademarks, or other intellectual property rights and laws. The user may use this material only as expressly authorized by hostelmania.com and may not copy, transmit or create derivative works of such material without express authorization. The user acknowledges and agrees that they shall not upload, post, reproduce, or distribute any content on or through CLUBMANIA that is protected by copyright or other proprietary right of a third party, without obtaining the permission of the owner of such right. Any copyrighted or other proprietary content distributed with the consent of the owner must contain the appropriate copyright or other proprietary rights notice. The unauthorized submission or distribution of copyrighted or other proprietary content is illegal and could subject the user to personal liability or criminal prosecution.

14 PERSONAL AND NONCOMMERCIAL USE LIMITATION

The Site is for your personal and noncommercial use. The content and information on the Site (including, without limitation, price and availability of travel services), as well as the infrastructure used to provide such content and information, is proprietary to hostelmania.com or its suppliers and providers. Accordingly, as a condition of using the Site, you agree not to use the Site or its contents or information for any commercial or non-personal purpose (direct or indirect). While you may make limited copies of your travel itinerary (and related documents) for travel or services purchased through the Site, you agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from the Site. In addition, whether or not you have a commercial purpose, you agree not to:
(i) access, monitor or copy any content or information of the Site using any robot, spider, scraper or other automated means or any manual process for any purpose without express written permission of hostelmania.com;
(ii) violate the restrictions in any robot exclusion headers on the Site or bypass or circumvent other measures employed to prevent or limit access to the Site;
(iii) take any action that imposes, or may impose, in the discretion of hostelmania.com, an unreasonable or disproportionately large load on the hostelmania.com infrastructure; or
(iv) deep-link to any portion of the Site (including, without limitation, the purchase path for any travel services) for any purpose without express written permission of hostelmania.com

16 NO UNLAWFUL OR PROHIBITED USE

As a condition of your use of the Site, you warrant that you will not use the Site for any purpose that is unlawful or prohibited by these terms, conditions, and notices.

17 TERMS, CONDITIONS AND WARRANTIES

Service Fee: These fees cover the costs incurred by hostelmania.com in servicing your travel reservation.

18 TRAVEL DESTINATIONS

Although most travel, including travel to international destinations, is completed without incident, travel to certain destinations may involve greater risk than others. hostelmania.com urges passengers to review travel prohibitions, warnings, announcements and advisories issued by the relevant Government Authority in your country of residence or the United Kingdom Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at www.fco.gov.uk. BY OFFERING ACCOMODATION IN PARTICULAR INTERNATIONAL DESTINATIONS, hostelmania.com DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND IS NOT LIABLE FOR DAMAGES OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. hostelmania.com's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of hostelmania.com's right to comply with law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by hostelmania.com with respect to such use. This agreement (and any other terms and conditions referenced herein) constitutes the entire agreement between the customer and hostelmania.com with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the customer and hostelmania.com with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Any rights not expressly granted herein are reserved.

19 CURRENCY CONVERTER

Currency rates are based on various publicly available sources and should be used as guidelines only. Rates are not verified as accurate, and actual rates may vary. Currency quotes may not be updated every day. Check the date on the Currency Converter for the day that currency was last updated. The information supplied by this application is believed to be accurate, but hostelmania.com does not warrant or guarantee such accuracy. When using this information for any financial purpose, hostelmania.com advises you to consult a qualified professional to verify the accuracy of the currency rates. hostelmania.com does not authorize the use of this information for any purpose other than personal use and prohibit to the maximum extent allowable the resale, redistribution, and use of this information for commercial purposes.

20 RESCHEDULE

All reservations have to be reconfirmed at least 24 hours before your scheduled arrival. Failure to do so may mean cancellation of reservation and hostelmania.com.com does not and cannot guarantee cancelled reservations can be rescheduled.

21 CANCELLATION AND REFUNDS

Only cancellation of reservations that have not passed the cancellation period will be entertained. Based on the cancellation period set by the supplier, there is a corresponding cancellation charge that is calculated as a percentage of the product and/or service priced. The user will be given the refund with the full reservation price less five percent bank transaction fee and cancellation charge.

22 COPYRIGHT COMPLAINTS

hostelmania.com respects the intellectual property of others. If you believe that any content appearing on the Site copies your work in a manner that constitutes copyright infringement, please contact us at info@hostelmania.com.

23 RISK OF LOSS

hostelmania.com accepts no risk of loss for products or services purchased via sites (e.g., Member sites) that link to the Site. The risk of loss shall remain solely with you or the vendor at the linked site.

24 DISPUTES

Any dispute relating in any way to hostelmania.com, the Site, or its services shall be resolved exclusively by confidential arbitration in UK. However, to the extent you have, in any manner, violated or threatened to violate hostelmania.com's proprietary rights, hostelmania.com may seek injunctive or other appropriate relief in any state or appropriate court in UK, and you consent to jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing in UK. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under these Terms and Conditions shall be joined to an arbitration involving any other party subject to these Terms and Conditions, whether through class arbitration proceedings or otherwise.

25 ENFORCEMENT AND MODIFICATIONS

Should you violate these Terms and Conditions, or any other rights of hostelmania.com, hostelmania.com reserves the right to pursue any and all legal and equitable remedies against you, including, without limitation, terminating your account with hostelmania.com. If hostelmania.com fails to enforce any right or provision in these Terms and Conditions, then you agree that this failure does not constitute a waiver of such right or provision or of any other provisions set forth in these Terms and Conditions. hostelmania.com reserves the right to alter or terminate any or all features or services at any time without notice. hostelmania.com also reserves the right, in its sole discretion, to edit or remove any content, make changes to the Site, and to revise its policies, and these Terms and Conditions, without notice, and such new terms shall be binding upon you. Therefore, hostelmania.com recommends that you check these Terms and Conditions each time you access the Site. If any provisions of these Terms and Conditions shall be deemed invalid, void, or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
